MOVE OVER LAW

Move Over Law Ammended Effective 1/1/2012

Tow truck operators and other authorized personnel involved in roadside assistance or highway maintenance will be included in the “Move Over” traffic safety law next year, according to a news release.

The law requires that, when possible, motorists must change lanes when they approach an incident where there is a vehicle with flashing red or amber lights, the release stated. The new law adds the amber lights. The amendment will take effect Jan. 1, 2012.

When it is not possible to move over, drivers must slow down.

Drivers who violate the Move Over law could be fined up to $275, plus a court surcharge of $85, and sentenced to up to 15 days in jail, the release stated. The driver also could receive three points on their driving record.

Roadside deaths in recent years have included state troopers in Westchester and Erie counties, an Onondaga County Sheriff’s deputy in Syracuse, and a man working on a lane striping crew in Erie County.

In November 2011, a tow truck operator was struck and killed while tending to a disabled vehicle on the state Thruway near Syracuse.

Starting January 1st New Yorkers are required by law to move over and slow down when they see emergency vehicles parked along state roads and highways.

The Ambrose-Searles Law is named after a state trooper and a sheriff's deputy. Trooper Robert Ambrose and Onondaga County Sheriff's Deputy Glenn Searles were both killed in the line of duty while their patrol cars were stopped on the side of the road.

The new law requires drivers to slow down when they see flashing lights. If you're on a road with more than one lane, you're required to move over when passing an emergency vehicle on the shoulder with its emergency lights flashing.

If you break the law, the fine can be up to $275 and you will get two points on your license.
